These Terms of Service (the "Terms") govern the use of the commercial Windows website downloader program ULTIMATE WEBSITE DOWNLOADER (the "Product"), the related website, licenses, updates, and customer support provided by MONOCREAT ("the Company").
By purchasing, downloading, installing, activating, or using the Product, you agree to these Terms. If you do not agree, do not purchase or use the Product.
The Company develops the Product and grants licenses to use it. The Merchant of Record for Product purchases is Paddle, which handles payment processing, tax calculation, receipts, and refunds.
During checkout you may also agree to Paddle's buyer terms and privacy notices. Paddle's terms apply to its payment services; these Terms apply to the license and use of the Product itself.
You represent and warrant that:
Minors may not purchase or use the Product without the valid consent and supervision of a parent or legal guardian.
The Product helps you save or organize publicly accessible resources from websites you specify onto your Windows device. Actual results depend on the target site's structure, server configuration, access permissions, network conditions, and third-party technology.
The Company does not guarantee that:
The Product does not provide hosting services, website-ownership verification, or permission to use third-party content.
Subject to your payment of applicable fees and compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, non-sublicensable license to install and use the Product for the term and scope stated in your purchase confirmation or order page.
The Company offers a single license type that does not distinguish between personal and business use. One license may be used by the purchaser on up to two (2) Windows PCs that you personally own or control. Legitimate commercial use for your own or your organization's business is permitted. Sharing, renting, reselling, transferring, or sublicensing the Product or a license key is prohibited.
A "Perpetual License" means the right to use the major version provided at the time of purchase continues without a time limit. Bug fixes or security updates for that major version may be provided, but a future new major version may require a separate purchase or a paid upgrade. It does not automatically include every future major version, feature, or unlimited technical support.
You must keep your license key, activation information, and account credentials secure. You must not publicly post them, or share, sell, rent, or transfer them beyond what these Terms allow.
If you suspect unauthorized use or a security breach, notify [email protected] immediately. The Company may apply reasonable activation limits to prevent fraud and verify licenses; support for normal device changes or reinstallation is described at ultimate-website-downloader.com.
You must use the Product only for websites or content that fall into one of the following categories:
You are solely responsible for identifying and complying with copyright, trademark, database rights, privacy, trade secrets, contractual restrictions, and any other third-party rights.
You must not use the Product, or allow anyone else to use it, to:
robots.txt, stated access restrictions, or applicable law;The Company does not own, control, or make any warranty about websites or content that you access or store using the Product. The fact that the Product is technically capable of accessing a particular site does not mean the Company authorizes that access, copying, or use, or that the Company is affiliated with that site.
You are responsible for confirming a target site's terms and obtaining any required permission from rights holders. If a third party requests removal, discontinuation, or a remedy for infringement, you are responsible for responding appropriately.
You are responsible for the URLs, settings, credentials, files, and any output you generate or store using the Product. The Company does not grant you ownership of third-party content that you obtained without lawful authorization.
Whether the Product operates locally, and whether it transmits diagnostic or license information to the Company's servers, is described in Part 2, Privacy Policy, of this document. You are responsible for backing up your own files.
Product prices and plans are shown on the order page. Payment is processed through Paddle, and displayed prices may include tax depending on your location, or tax may be added at checkout.
You must provide accurate and current payment and contact information. If a payment fails, or is canceled or charged back, delivery of the Product or license activation may be refused or suspended.
The Company may change prices for future purchases. Price changes are not applied retroactively to a completed one-time purchase. If a subscription product is offered, price changes and renewals will be disclosed in accordance with Paddle's buyer terms and applicable law.
If the Company offers a subscription plan and you select it, the subscription automatically renews at the interval shown at checkout, and Paddle may process recurring payments until you cancel.
You may cancel a subscription through the Paddle buyer portal or the method provided in your payment confirmation email. Unless otherwise disclosed or required by law, cancellation takes effect at the end of the current billing period and stops the next renewal charge. Refunds for an already-started period are governed by the Refund Policy and applicable law.
Refunds are governed by the Company's Refund Policy (Part 3 of this document), Paddle's official refund policy, and applicable consumer protection law. Refund eligibility follows Paddle's refund policy and applicable consumer protection law; the Company does not offer a separate refund guarantee beyond those rights. How requests are reviewed and reasonable anti-abuse standards are set out in the Refund Policy.
Approved refunds are processed through Paddle to the original payment method where possible. If a refund is approved or completed, or a chargeback is filed, the related license and Product access may be deactivated or suspended during investigation. The voluntary refund benefit (once per customer), repurchase after a refund, and the treatment of partial refunds are set out in the Refund Policy.
The Company may provide updates or patches for security, compatibility, feature improvements, or legal requirements. Updates may come with additional terms, and some functionality may stop working if you do not install important security updates.
The Company may modify or discontinue features after reasonable notice, provided this does not unduly limit your rights under applicable law or the Company's obligations regarding core functionality of a Product you have already purchased.
The scope, response time, and duration of customer support are described at [email protected] or on ultimate-website-downloader.com. The Company does not guarantee a resolution time, or that every issue can be resolved in every environment.
Ownership and intellectual property rights in the Product, its source code, executables, design, documentation, trademarks, and all related materials provided by the Company belong to the Company or its licensors. You receive only the usage rights stated in these Terms; no ownership is transferred.
Feedback you provide may be treated as non-confidential. You allow the Company to use such feedback to improve the Product without any obligation to compensate you. Your personal data is still handled under the Privacy Policy.
You may terminate your license under these Terms at any time by stopping use of the Product and deleting your copies. Refund eligibility is governed separately by the Refund Policy.
To the extent applicable law allows, the Company may suspend or terminate your license or access if:
Where a breach is curable, the Company may provide a reasonable opportunity to fix it, but may act without prior notice where necessary to address an urgent security risk, fraud investigation, legal prohibition, or harm to a third party.
On termination, your right to use the Product ends immediately and you must stop using it. Provisions that by their nature should survive termination — including intellectual property, limitation of liability, dispute resolution, unpaid amounts, and similar clauses — remain in effect.
The Company aims to provide the Product with reasonable care and skill. However, to the maximum extent permitted by applicable law, the Product is provided "as is" and "as available," and the Company does not warrant that:
This section does not exclude any mandatory consumer right that the Product must match its description and have reasonable quality and fitness for purpose.
To the maximum extent permitted by applicable law, the Company is not liable for indirect, special, incidental, punitive, or consequential damages, or loss of profits, revenue, data, business opportunity, or goodwill. In particular, you are responsible for losses arising from your own unauthorized downloads, third-party rights infringement, changes or blocking by a target site, use of your output, or failure to back up your data.
The Company's total liability arising out of the Product or these Terms will not exceed the amount you actually paid for the Product giving rise to the claim during the 12 months before the claim arose.
The above limitations do not apply to liability for:
Some jurisdictions do not allow certain warranty exclusions or liability limitations, so some of the above limitations may not apply to you.
If you use the Product for a business, professional, or commercial purpose, you agree to defend and indemnify the Company against third-party claims and reasonable costs arising from your unlawful use, breach of these Terms, or infringement of third-party rights, except to the extent caused by the Company's own intentional misconduct or negligence.
This section does not limit any mandatory statutory rights that apply to consumers.
The Company is not liable for delay or failure to perform caused by natural disasters, war, terrorism, labor disputes, government action, changes in law, power outages, telecommunications, internet, or cloud outages, third-party platform outages, cyberattacks, or other events reasonably beyond the Company's control. The Company will make reasonable efforts to mitigate the impact.
The Company may change these Terms to reflect changes in law, security, the Product, or business operations. Material changes will be announced through the website, an in-product notice, or a customer email, and prior consent will be obtained where required by applicable law.
Revised Terms apply from the stated effective date. Absent a separate legal basis, the Company will not retroactively and adversely reduce the core rights of a completed one-time purchase. If you do not agree to a change, you may cancel any subscription and stop using the Product before it takes effect.
These Terms are governed by the laws of the Republic of Korea, excluding its conflict-of-law rules. If a dispute arises, you should first contact [email protected] to seek a resolution, and the Company will make a good-faith effort to resolve it.
Disputes not resolved through discussion are subject to the exclusive jurisdiction of the Korean courts with jurisdiction over the Company's place of business. Consumers retain any right under the mandatory consumer-protection law of their country of residence to bring a claim before their own courts or authorities. Disputes concerning Paddle's payment services or the transaction itself may separately be governed by the governing-law and dispute clauses in Paddle's buyer terms.
The Company's handling of personal data is governed by the Privacy Policy (Part 2 of this document). Paddle may act as a separate or independent controller of information related to payment, processing it under its own privacy notice.
